Draft for review. This policy is a working draft written to the shape Indian e-commerce and payment-gateway rules expect. It has not been reviewed by a lawyer. Have it checked, and fill in the registered entity name, GSTIN and grievance officer, before the site accepts money.
Who we are
These terms govern purchases from Fakhruddin & Sons of 214 Chowk Bazaar, Nanpura, Surat 395001, Gujarat, India. Registered entity name, GSTIN and CIN to be inserted before launch.
By placing an order you accept these terms. If you do not accept them, do not place an order — telephone us instead and we will deal with you directly.
Orders
An order placed on this site is a request, not a concluded contract. We confirm every order by telephone before anything is cut or dispatched. The contract forms only when we confirm.
We may decline an order — if a size is not available, if the cloth has run out, or if we do not believe the garment will suit the use you describe. We will say so plainly and refund anything paid.
Prices
Prices are in Indian Rupees and inclusive of GST unless stated. Cloth sold by the metre is priced per metre and cut to your instruction.
Contract rates for schools are quoted in writing and held for the term stated in the quotation. List prices on this site do not apply to contract orders.
Bespoke and made-to-measure
Bespoke garments are cut to a paper pattern drafted for one person. Because the cloth is cut irreversibly, a bespoke commission cannot be cancelled once cutting has begun, and cannot be returned except for a fault in our work.
We include the fittings described on the commission page. If a garment does not fit at the final fitting, it goes back to the workroom — the delivery date is never a reason to accept a garment.
Cloth cut to length
Cloth cut from the bolt to your instruction cannot be returned or exchanged, because it cannot be sold on. Please be certain of the length before we cut.
Payment
We accept payment on collection, by UPI on confirmation, and by invoice for schools on a contract account. Card and gateway details to be inserted when the payment provider is appointed.
Liability
Nothing in these terms limits our liability for death, personal injury, or fraud. Otherwise our liability for any order is limited to the value of that order.
Governing law
These terms are governed by the laws of India, and the courts at Surat, Gujarat have exclusive jurisdiction.
Grievances
Grievance officer name, email and telephone to be inserted before launch, as required by the Consumer Protection (E-Commerce) Rules 2020. We aim to acknowledge a complaint within forty-eight hours and resolve it within one month.
Questions
Ask us directly
We would rather explain it on the telephone than have you read it twice.
